These Terms & Conditions ("Terms") govern your access to and use of RestFlags, a feature-flag, targeting and experimentation platform operated by Etariosk ("RestFlags", "we", "us", or "our"), including the dashboard at restflags.com, the public flag-evaluation API at /api/v1, and related pages (together, the "Service").

By creating an account or using the Service you ("you", "Customer") agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you have authority to bind it, and "you" means that organisation. If you do not agree, do not use the Service.

1. The Service

RestFlags lets you create and evaluate feature flags, define targeting rules and segments, run experiments, and manage these through a dashboard and a single REST API endpoint. We may add, change or remove features over time. We may also offer the public flag API through a separate edge service; these Terms apply to it equally.

2. Accounts and eligibility

  • You must sign in with Google or GitHub (via Firebase Authentication) to use the dashboard. You are responsible for maintaining the security of the provider account you use to access the Service.
  • You must be at least 16 years old and capable of forming a binding contract.
  • You are responsible for all activity that occurs under your account and within your workspaces, including the actions of team members you invite.

3. Workspaces, teams and roles

You may invite team members to a workspace and assign them roles (viewer, editor, admin, owner) that determine their permissions. You are responsible for assigning appropriate roles and for the actions of everyone you grant access to. Workspace owners control billing and workspace settings.

4. API keys and security

  • API keys authenticate your application to the public API. The full secret is shown only once at creation; we store only a hash of it.
  • You are responsible for keeping API keys confidential, scoping them to the least privilege needed, and rotating or revoking any key that may have been exposed.
  • You must not exceed the rate limits applied to the API (enforced per API key and per client IP, as described in our documentation), attempt to circumvent environment restrictions, rate limits or IP allowlists, or use a key in a way it was not issued for. We are not liable for losses arising from your failure to secure a key.

5. Acceptable use

You agree not to:

  • use the Service to violate any law or infringe the rights of others;
  • transmit malware, attempt to gain unauthorised access to the Service or its infrastructure, or probe, scan or test its security without authorisation;
  • interfere with or disrupt the integrity or performance of the Service, including by exceeding rate limits, scraping, or generating abusive request volumes;
  • resell, sublicense or provide the Service to third parties except through your own application's legitimate use; or
  • send us, through the evaluation API, any data you do not have the right to process, or any special categories of sensitive personal data you have not lawfully cleared for processing.

We may suspend or terminate access that we reasonably believe violates this section.

6. Customer data and ownership

  • Your data is yours. You retain all rights to the flags, segments, experiments, configuration and end-user evaluation context you submit ("Customer Data").
  • You grant us a limited licence to host, process and transmit Customer Data solely to provide and operate the Service.
  • For end-user evaluation context, you act as the data controller and we act as your processor. You are responsible for having a lawful basis to send that data and for your own users' privacy notices. Our handling of personal data is described in our Privacy Policy.

7. Plans, billing and payment

  • The Service is billed on API requests. One request is a single HTTP call to any /api/v1/flags endpoint, regardless of how many flags it evaluates.
  • Every account includes its first 100,000 requests free, shared across all the workspaces it owns. Usage is cumulative over the lifetime of the account — it never resets.
  • Pay-as-you-go is $5 per million requests beyond the free allowance.
  • Free-plan limits. We notify your billing contact at 80% of the free quota. At 125% of the free quota, the public API is paused for all workspaces on the account and returns an HTTP 402 error until you move to a paid plan. Paid plans are not paused; overage is invoiced.
  • Manual billing. Paid plans, custom limits and Enterprise terms are arranged directly with us by emailing contact@restflags.com. Fees are payable as agreed in your plan arrangement. Except where required by law, fees are non-refundable.

8. Service availability

We work to keep the Service available and reliable, but unless a separate written agreement (for example an Enterprise plan) states otherwise, the Service is provided without any guaranteed uptime or service-level commitment. We may perform maintenance, and we may modify or discontinue features with reasonable notice where practicable.

9. Suspension and termination

  • You may stop using the Service and close your account at any time.
  • We may suspend or terminate your access if you breach these Terms, fail to pay fees due, or use the Service in a way that poses a security, legal or operational risk.
  • On termination, your right to use the Service ends. We may delete Customer Data after a reasonable period, subject to our Privacy Policy and any legal retention obligations. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability and governing law) survive termination.

10. Intellectual property

The Service, including its software, design, and documentation, is owned by Etariosk and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership to you. You may not copy, modify, reverse-engineer or create derivative works of the Service except as permitted by law.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that flag evaluations will always be delivered without delay or failure. You are responsible for designing your application to degrade gracefully if a flag evaluation is unavailable.

12. Limitation of liability

To the maximum extent permitted by law, RestFlags and Etariosk will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the three months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You will defend, indemnify and hold harmless RestFlags and Etariosk from and against any claims, damages and costs (including reasonable legal fees) arising from your use of the Service, your Customer Data, or your breach of these Terms or of applicable law.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date below and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws applicable to Etariosk's place of establishment, without regard to conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the courts located there for any dispute that cannot be resolved informally. Nothing in this section affects mandatory consumer protections you may be entitled to in your country of residence.
